M. for the formation of the constitution. N. Roy first advocated the need for a Constitution Drafting Committee for India in 1934. The Indian National Congress first made an official demand for the formation of a Constituent Assembly in 1935. In 1938, Jawaharlal Nehru declared on behalf of the Indian National Congress that the constitution of independent India should be framed by a Constituent Assembly (without external interference) elected on the basis of universal adult suffrage.
The demand for the establishment of a Constituent Assembly was accepted by the British Government in the August Offer of 1940. In 1942, British Cabinet member Sir Stapard Cripps put forward some proposals to the Indian leaders regarding the establishment of a Constitution Drafting Committee. These are popularly known as Cripps propositions. Both the Congress and the Muslim League rejected the Cripps proposal. Finally, a Constituent Assembly was established in 1946 to draft a constitution for independent India on the recommendation of a Cabinet delegation.
Formation of Constituent Assembly
Elections were held in July 1946 for the establishment of a Constitution Drafting Committee in accordance with the recommendations of the Cabinet Committee. A Cabinet Commission had recommended indirect elections. Therefore, although some members of the Constituent Assembly are elected by the members of the Provincial Legislative Assemblies. A few more members were nominated by domestic principalities. The Constituent Assembly had a total of 389 members. Of these, 296 members were elected from British India (provincial legislatures). And 93 members were nominated from domestic states.
Thus the Constituent Assembly was an indirectly elected and nominated body. In the Constituent Assembly elections, the Congress won 208 seats and the Muslim League won 73 seats.
Hindus, Muslims, Anglo-Indians, Scheduled Castes, Backward Tribes, etc. were represented in the Constituent Assembly.
